These Terms & Conditions (“Terms”) are a binding agreement between you and The Gamblin Group (“Company,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

We may modify these Terms at any time. When we do, we will update the “Last updated” date above. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

You must have the legal authority to agree to these Terms. If you create an account, you are responsible for maintaining its security and for all activity under your credentials. Notify us immediately of any unauthorized use.

9. Limitation of Liability

To the maximum extent permitted by law, The Gamblin Group will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising from or related to your use of the Services. Our aggregate liability for all claims shall not exceed the greater of (a) the amount you paid us for the Services in the 3 months preceding the event giving rise to the claim, or (b) $100.

You agree to defend, indemnify, and hold harmless The Gamblin Group and our affiliates, officers, directors, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.

11. Electronic & SMS Communications

By providing your email or phone number, you consent to receive communications (including marketing) from us. Message & data rates may apply. You may opt out of marketing emails via the unsubscribe link, and you may opt out of SMS by replying STOP. Reply HELP for help.

12. Suspension & Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including suspected violations of these Terms. Upon termination, your right to use the Services ceases immediately.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws principles. Any dispute will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Rules. You and we waive the right to a jury trial and to participate in class actions. Either party may seek injunctive relief in a court of competent jurisdiction.
